Terms of Service for Shepherd

1. Introduction

Welcome to Shepherd! These Terms of Service ("Terms") govern your use of the Shepherd mobile application (the "Service"), provided by MARCUS GUNN ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

Please read them carefully. If you do not agree to these Terms, do not use the Service.

2. The Service

Shepherd is a digital wellness application designed to help users ("Users") manage their screen time with the help of an accountability partner, known as a "Shepherd."

User Role

As a User, you can set limits on your app usage, monitor your screen time, and invite a Shepherd to help you stay accountable. A paid subscription is required to use these features.

Shepherd Role

As a Shepherd, you can be invited by a User to help them manage their screen time. The Shepherd role is free and does not require a subscription. An invitation is sent via a unique code generated by the User. Once connected, a Shepherd can:

• View the limits the User has set.
• See the number of apps and categories selected for each limit.
• Modify limit details, including the name, description, time allowance, and block duration.
• Lock a User's limits, which prevents the User from changing them.
• Unlock a User's limits.

Only a Shepherd can lock or unlock a User's limits.

3. User Accounts

To use Shepherd, you must create an account. Sign-up is handled through Apple's anonymous authentication service. Upon your first login, you will be required to create a unique username. You are responsible for all activities that occur under your account.

4. Subscriptions and Payments

For Users

A subscription is required for Users to access the core features of the Service, such as setting and managing their own screen time limits.

For Shepherds

The Shepherd role is provided free of charge. No subscription is required to accept an invitation and manage a User's limits.

Payment, Renewals, and Refunds

All payments, renewals, and refunds are processed through the Apple App Store and are subject to Apple's terms and conditions. We do not handle payment processing directly. For more information, please review the Apple Media Services Terms and Conditions.

5. Acceptable Use

You agree not to misuse the Service. This includes, but is not limited to, attempting to hack, reverse-engineer, or otherwise abuse the system. We reserve the right to suspend or terminate accounts that violate this policy.

6. Termination

We may terminate or suspend your access to the Service at our sole discretion, without prior notice or liability, for any reason, including if you breach these Terms. If we terminate your account for attempting to hack or abuse the system, you will not be entitled to a refund.

7. Account and Data Deletion

Shepherd uses an anonymous login system. If you delete the application from your device, most of your associated data will be removed. To request a complete and permanent deletion of all your data from our systems, please contact us at m_gunny31@outlook.com.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, express or implied. We do not guarantee that the Service will always be secure, error-free, or that it will function without disruptions or imperfections.

9. Limitation of Liability

To the fullest extent permitted by applicable law, MARCUS GUNN shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of South Australia, Australia, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms within the app or on our website. You are advised to review these Terms periodically for any changes.
